GameQuiz Terms of Service

1. Operator and service
GameQuiz is an independent Discord application operated in France under the public name Koziel. Contact: gamequiz.contact@gmail.com.
GameQuiz provides daily video-game quizzes, private answer submission while a quiz is open, corrections, rankings, statistics, seasons, profiles, achievements, image quizzes, reporting/support tools and server configuration features.
2. Agreement to these Terms
By installing GameQuiz, configuring it for a Discord server, or voluntarily interacting with GameQuiz as a player, you agree to these Terms to the extent applicable to your use. If you do not agree, do not install or use GameQuiz. These Terms are solely between the user and the GameQuiz operator. Discord is not a party to them.
Your use of Discord remains separately subject to Discord's own Terms of Service, Community Guidelines, Developer Platform rules where applicable, and other Discord policies. These GameQuiz Terms do not override Discord's terms.
3. Eligibility
You must be legally permitted to use Discord and meet Discord's minimum-age requirements and any higher age required by applicable law. A person installing or configuring GameQuiz for a server must have the Discord permissions necessary to do so and must not falsely claim authority over a server.
4. Free beta status
The current version of GameQuiz is provided free of charge as a public beta. Features, schedules, question sets, technical architecture and availability may evolve during the beta. No score, rank, achievement, season title or other GameQuiz result has monetary value.
If GameQuiz later offers paid features, subscriptions or digital purchases, separate or updated terms covering price, billing, renewal, cancellation, refunds and applicable consumer rights will be made available before purchase.
5. Server administration
Server administrators are responsible for choosing the GameQuiz channel, language, time zone, schedule, reminder and notification settings, quiz filters and other available server configuration options, and for granting GameQuiz only the permissions reasonably necessary for its operation. Administrators are also responsible for the moderation and retention of messages already published in their Discord server.
6. Acceptable use
You must not use, attempt to use, or enable others to use GameQuiz to:
- violate applicable law, Discord's rules, or third-party rights;
- obtain passwords, tokens, credentials or other secrets;
- bypass Discord or GameQuiz security, permission, rate-limit or privacy controls;
- intentionally disrupt, overload, exploit, probe or compromise GameQuiz or its infrastructure;
- automate abuse, manipulate rankings through exploits, or knowingly submit malicious payloads;
- abuse the reporting or support features, including by knowingly submitting malicious or unlawful content;
- use GameQuiz to distribute unlawful, infringing, hateful, threatening or otherwise prohibited content.
7. User submissions, quiz answers and reports
Users retain any rights they may have in text they submit. By submitting a quiz answer, the user gives GameQuiz a limited, non-exclusive permission to receive, store, compare, process and, when the quiz closes, display that answer together with the user's Discord display name and result to the extent necessary to operate the quiz and its correction. This permission ends when the relevant data is deleted, except for copies already published in Discord messages, temporary backups awaiting expiry, or retention required by law.
If a user submits a report or takes part in a related support conversation, GameQuiz may receive, store and display that content to the people responsible for handling the report, as described in the Privacy Policy.
Users should not submit confidential, sensitive, unlawful or unnecessary personal information in GameQuiz answer, report or support fields.
8. Scores, corrections and disputes
GameQuiz uses automated answer matching and locally defined accepted-answer lists. It aims to provide fair results, but questions, translations, image sources, answer aliases, connectivity and software can contain errors. The operator may correct a score, answer key, achievement, ranking or season result where reasonably necessary to correct an error, resolve abuse or preserve the integrity of the game.
Image quizzes depend on external game data, screenshots and automated filtering. An incorrect image, missing image, false text detection or provider mismatch may occasionally occur and may be corrected or cancelled where appropriate.
A suspected quiz error may be reported through GameQuiz's reporting tools, the official support server or at gamequiz.contact@gmail.com.
9. Availability, maintenance and changes
GameQuiz is provided on an “as available” basis. Maintenance, Discord platform changes, hosting incidents, third-party API outages, rate limits or other technical events can interrupt or change the service. The operator may update, add, remove, pause or discontinue features for operational, security, legal or product reasons. Where a change materially affects privacy practices or user rights, the relevant legal notice will be updated.
10. Suspension and termination
Access to GameQuiz may be restricted or terminated for serious abuse, attacks on the service, violations of these Terms, Discord enforcement, legal requirements or security reasons. Server administrators can remove GameQuiz from their server at any time through Discord.
Removing GameQuiz starts the server-data retention/deletion process described in the Privacy Policy. Individual users can also use the available data-deletion command or contact GameQuiz.
11. Third-party services
GameQuiz depends on third-party services, including Discord, Railway, Steam, Twitch/IGDB, RAWG when configured, and GitHub Pages for the public website. Their availability and their own terms and privacy practices are outside GameQuiz's direct control. Third-party terms may apply independently when users access those services or follow links to them.
Video-game information is obtained from IGDB. Image quizzes use screenshots primarily from Steam, with IGDB and RAWG as fallbacks when available and configured. GameQuiz is not endorsed by or affiliated with Discord, Valve/Steam, Twitch, IGDB, RAWG or the publishers/developers of the games appearing in quizzes unless expressly stated otherwise.
12. Intellectual property
Game names, trademarks, logos, screenshots, artwork, characters and other third-party materials remain the property of their respective rights holders. Nothing in these Terms transfers ownership of third-party intellectual property.
The GameQuiz name, original GameQuiz text, branding, software and other original materials are protected to the extent provided by applicable law. No permission is granted to impersonate GameQuiz, misrepresent an unofficial service as official, or use GameQuiz branding in a deceptive manner.
Rights holders with a good-faith concern about content used by GameQuiz may contact gamequiz.contact@gmail.com.
13. Privacy and data protection
Personal-data processing is governed by the GameQuiz Privacy Policy. Users can access or delete active GameQuiz data through the available privacy commands or by contacting gamequiz.contact@gmail.com.
14. No warranties beyond mandatory law
To the maximum extent permitted by applicable law, GameQuiz is provided without a guarantee of uninterrupted availability, perfect accuracy, fitness for a particular purpose or compatibility with every Discord configuration. Nothing in these Terms excludes or limits any statutory guarantee, consumer right or liability that cannot legally be excluded.
15. Limitation of liability
To the extent permitted by applicable law, the operator is not liable for indirect or consequential losses arising solely from outages, loss of non-monetary GameQuiz scores, Discord platform changes, third-party outages, server misconfiguration or unauthorised third-party activity outside the operator's reasonable control. This clause does not exclude liability where exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct or other non-excludable matters.
16. Governing law and disputes
These Terms are governed by French law, without depriving a consumer of any mandatory protection granted by the law of the country in which that consumer habitually resides where such protection applies. Before bringing a dispute where reasonably possible, users are invited to contact gamequiz.contact@gmail.com so that the issue can be examined and an amicable solution attempted. Jurisdiction is determined by the mandatory rules applicable to the dispute.
17. Changes to these Terms
These Terms may be updated when GameQuiz's functionality, legal obligations, third-party dependencies or business model change. Material changes will be reflected by a new version/effective date and may also be announced through the official support server or GameQuiz information channels where appropriate. Continued use after the effective date is subject to the updated Terms, without limiting rights that cannot legally be waived.
18. Severability and non-waiver
If a provision of these Terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.
